By accessing this website we assume you accept these terms and conditions. Do not continue to use SmartKit if you do not agree to take all of the terms and conditions stated on this page.

1. License & Intellectual Property Rights

Unless otherwise stated, SmartKit and/or its licensors own the intellectual property rights for all material on SmartKit. All intellectual property rights are reserved. You may access this from SmartKit for your own personal use subjected to restrictions set in these terms and conditions.

You must not:

• Republish material from SmartKit
• Sell, rent or sub-license material from SmartKit
• Reproduce, duplicate or copy material from SmartKit
• Redistribute content from SmartKit without explicit permission

2. User Conduct & Acceptable Use

You must not use this website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

You are strictly prohibited from uploading, sharing, or processing:

• Malware, viruses, or any other malicious computer code
• Pirated content, copyrighted material without authorization, or intellectual property belonging to others
• Illegal, explicit, or highly offensive material
• Content that promotes violence, discrimination, or illegal activities

Site Access & IP Blocking: We reserve the right to monitor site activity and IP addresses for security purposes. If you violate these Terms of Use, engage in malicious activity, or attempt to bypass security controls, SmartKit may permanently block your IP address from accessing the platform without prior notice.

3. Compliance, Safety, and Legal Requests

SmartKit may suspend access, remove content, preserve records, or disclose relevant account, tool, activity, file, message, or log data when reasonably necessary to comply with applicable law, a valid government or law enforcement request, a court order, or other legal process.

We may also review or preserve relevant information to protect users, investigate abuse, fraud, security incidents, harmful activity, service misuse, copyright or rights complaints, or violations of these Terms. Where appropriate and legally permitted, we aim to limit any disclosure to the information reasonably required for the specific request or investigation.

4. Temporary Storage & Data Retention

SmartKit provides tools that involve temporary file storage, file manipulation, and temporary chat rooms. You acknowledge that all uploaded files, generated documents, and chat records are stored temporarily and are subject to automated deletion to maintain server performance. SmartKit is not a permanent storage or backup service. We cannot recover files once they expire or are deleted by our automated systems.

5. SmartKit Bio Pro

SmartKit Bio Pro allows users to create public link in bio pages. You are responsible for the accuracy, legality, and ownership of any profile text, images, files, links, posts, or social profiles you publish. SmartKit may remove Bio content that violates these Terms, infringes rights, or creates security or abuse risks.

6. Voice Rooms and Real-Time Peer-to-Peer Services

Voice Rooms and other real-time tools are provided for lawful live audio calls, group conversations, and broadcast listening.

These features use direct peer-to-peer (P2P) connections. By using these tools, you acknowledge that your communications travel directly between your device and the other participants. SmartKit does not (and cannot) intercept, record, monitor, or access the audio, files, or text transmitted through these P2P connections.

SmartKit may offer rooms with no platform time limit and high listener capacity, but actual performance can depend on browser permissions, device capability, network quality, hosting resources, and third-party real-time audio services. You are solely responsible for what you say, stream, invite, or moderate inside your rooms.

7. StreamFeed

StreamFeed is a tool designed to transmit real-time video directly from your camera to your own broadcasting software (e.g., OBS Studio).

You are solely responsible for the content you broadcast using StreamFeed. You agree not to use StreamFeed to broadcast any illegal, illicit, or unauthorized copyrighted content. StreamFeed relies on peer-to-peer (P2P) WebRTC connections; SmartKit acts only as a signaling server and does not intercept, store, or process the video stream.

8. AcademiCard

AcademiCard is provided to educational institutions for publishing student results. By uploading data to AcademiCard, you represent and warrant that you are an authorized administrator of the institution and that you have the legal right and necessary consents to process and publish the students' performance data.

SmartKit does not verify the accuracy of the results uploaded and is not liable for errors, omissions, or consequences arising from the publication of incorrect grades. We reserve the right to suspend or delete any school account that violates these Terms or uses the platform for unauthorized data dissemination.

9. OCR Scanner & Client-Side Tools

OCR Scanner, as well as many of our PDF conversion tools (like Word to PDF), operate entirely within your local web browser.

This means your sensitive documents and images are never uploaded to our servers for processing. The extraction of text and conversion of files happens securely on your own device using JavaScript. By using these tools, you agree that SmartKit is not responsible for the accuracy of the text extracted or the formatting of the generated documents.

9a. TypeSpeed Typing Test

TypeSpeed is a free typing speed test provided for personal practice and self-assessment. Test results, including words per minute and accuracy, are generated in your browser and are provided for informational purposes only.

You agree not to abuse the tool through automated scripts, falsified result submissions, or any attempt to manipulate usage statistics. SmartKit makes no guarantee that any score reflects a certified or official typing speed, and accepts no liability for decisions made based on results from this tool.

9b. SpinPick Random Pickers

SpinPick (Spin Wheel, Giveaway Draw, Team Generator, Coin Toss, Dice Roller, List Shuffler, and Random Number Generator) is provided for entertainment, decision-making, and giveaway or raffle administration purposes. All results are generated using a secure random selection process, but you agree that SmartKit is not a lottery, gambling, or licensed sweepstakes operator, and is not responsible for verifying eligibility, administering prizes, or resolving disputes between an organizer and participants of any giveaway you run using this tool.

If you run a giveaway, contest, or raffle using SpinPick, you are solely responsible for complying with any applicable laws or platform rules (such as social media promotion guidelines) governing that giveaway, and for the accuracy of any participant list you upload. You agree not to use SpinPick to publish participant lists containing personal information you are not authorized to share.

9c. CaptionCast Live Captions

CaptionCast converts speech you speak into your device's microphone into live text captions using your browser's built-in speech recognition. You are solely responsible for the content of anything you say while a session is active, and for obtaining consent from anyone else whose voice may be captured by your microphone during a session.

CaptionCast is provided for live captioning, accessibility, and stream/broadcast overlay purposes. SmartKit does not guarantee the accuracy of any caption or transcript generated, since accuracy depends entirely on your browser's speech recognition engine, microphone quality, and background noise. You agree not to use CaptionCast to caption or transmit audio containing illegal, harassing, or copyrighted material you are not authorized to reproduce.

10. AudioKit - Browser-Based Audio Editor

AudioKit is a browser-based audio editing tool that processes all files locally on your device using WebAssembly. No audio data is ever uploaded to SmartKit's servers at any stage.

By using AudioKit, you confirm that you are the legal owner of, or hold the necessary rights and licenses to, any audio content you edit or convert using this tool. You agree not to use AudioKit to process copyrighted material without proper authorization. SmartKit accepts no liability for any copyright infringement arising from how you choose to use the output of AudioKit.

11. ImageKit - Browser-Based Image Editor

ImageKit is a browser-based photo editor and bulk processor that operates locally on your device. No image data is ever uploaded to SmartKit's servers.

By using ImageKit, you confirm that you are the legal owner of, or hold the necessary rights to, any image content you edit, watermark, or convert using this tool. SmartKit accepts no liability for any copyright infringement arising from how you choose to use the output of ImageKit.

11a. InvoiceKit - Invoices, Quotations & Payment Records

InvoiceKit is a document-creation and record-keeping tool that helps you build invoices, quotations, estimates, receipts, and payment records for your own business. It is a self-service tool: you are solely responsible for the accuracy of every business detail, client detail, item, price, tax rate, discount, currency, amount, and note you enter, and for the content of any document you generate, download, print, or share.

SmartKit is not an accounting, bookkeeping, tax-filing, payment-processing, or financial-advisory service, and does not process, hold, transfer, or collect any funds on your behalf. InvoiceKit does not verify or calculate your legal or tax obligations. You are solely responsible for determining and complying with all invoicing, tax (including VAT/GST), record-keeping, and regulatory requirements that apply to you in your own jurisdiction, and for confirming that any tax rate or legal information shown on a document you create is correct. Nothing generated by InvoiceKit constitutes tax, legal, accounting, or financial advice.

Where you enable a public status link or QR code for an invoice or quotation, you acknowledge that anyone with that link can view the document and its payment status without logging in, and that you are responsible for sharing it only with intended recipients. You may regenerate or disable any such link at any time. Your billing data is stored in your own private workspace and is subject to the temporary-storage and data-retention terms above; SmartKit is not a permanent storage, backup, or archival service for your financial records, and you are responsible for keeping your own copies as required by law.

9. Assignment

SmartKit may assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification or consent required. However, you shall not assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

9. Disclaimer of Warranties

This website is provided "as is" without any representations or warranties, express or implied. SmartKit makes no representations or warranties in relation to this website or the information and materials provided on this website.

Without prejudice to the generality of the foregoing paragraph, SmartKit does not warrant that: this website will be constantly available, or available at all; or the information on this website is complete, true, accurate or non-misleading. Nothing on this website constitutes, or is meant to constitute, advice of any kind.

9. Limitation of Liability

In no event shall SmartKit, nor any of its officers, directors and employees, be held liable for anything arising out of or in any way connected with your use of this website whether such liability is under contract. SmartKit, including its officers, directors and employees shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this website, including data loss, loss of revenue, or business interruption.

10. Indemnification

You hereby indemnify to the fullest extent SmartKit from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.

11. Severability

If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

12. Variation of Terms

SmartKit is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review these Terms on a regular basis. Your continued use of the site following the posting of changes will mean that you accept and agree to the changes.
